I Ride: 2006 ST1300A-02'Falco

My Turn

Yesterday I left at 6am to go spend the weekend 40 miles south of John Day with some riders from Or.Since it was a little chilly everyone was still in camp when I got there.Joined a group that were doing a 300 mile loop.About 1:30 we came around a downhill right hander with a corkscrew and exited with a left hand corner.The guy behind me said that my rearend of the bike started wobbling in the first part of the corkscrew.Front tire dropped off the shoulder and I highsided into a Juniper tree.Bike can be fixed when the funds allow.I have a broken left thumb and right collarbone.So no rides for me awhile.First street wreck and have been endorsed since'69.Almost forgot OSP came by the hospital to give me a carelees riding ticket for $472.Said the sides of my tires were all scrubbed down from aggressive riding.

Holy shiat...Glad your ok Gemstate and those OSP guys are totall douches with no mercy they find anything they can on anyone. Are you going to fight the ticket?

Wow, good to hear your relatively alright.

As for the ticket, I would think that would be easily fightable.

Won't they have to prove that...
a. having tires scrubbed in to that extent was resultant from "aggressive riding"
and if so that ...
b. the "aggressive riding" occurred during the time of the incident.

Unless OPD can give out tickets just by looking at your tires. (apparently they can.)

wow i am glad you are not seriously hurt. That is ###ked up of them to give you a ticket. Since when can they give you a ticket for that?
I think that its easily fight able. I would take them to court. thats ridiculous.

Thanks for all the well wishes and offers for help.I am home and the bike is getting picked up today.I will plead no contest to the ticket and try to get it to a failure to keep right(or rightside up).No pics of the bike yet but here are some colorful ones.

You ever go to the track?
Lord knows my tires are scrubbed to the very edge from that. I'd demand they prove it was done on the road vs the track.

Glad to hear your are Ok and in good spirits. Bikes can be fixed. What caused the wobble? That is a BS ticket, I never heard of a cop trying that one. I guess if you are from out of the state they must figure you will not come back and try and fight it. This one is worth fighting. If that cop had a beer last week he is an alcoholic and I think he must have been drunk when he wrote that ticket. The powers of speculation, misdirection, and spin.

Tell em you took your bike down to miller for a track day and those are the tires that you used. Scuffed em up down there, yet they are still Perfectly legal for street use. then flip em the bird and tell 'em to go catch some real criminals.

I agree with the other guys. The ticket is definitely bogus. My kid got one for 93 in a 65. His cruise was set at 69, the cop was dyslexic. Also, since their court is in Pendleton, the cop didn't expect him to show. When my kid showed up at court, no cop. Therefore no ticket. Cost him a tank of gas and a day of driving and saved $400.00.

My condolences, Bill.

Seneca must be where yawl stayed as it's a popular spot for motorcyclists.

I would definitely look into having that other rider, who saw your bike wobbling, send a letter to help your case.

Try to find the case of the wobble as it might well be a mechanical failure or a slow leak from rear tire.

OSP investigated the accident and obviously surmised that you're an aggressive rider based on those well scrubbed tires.

My cruiser has well scrubbed tires (no chicken strips) and am sure I'd get the same ticket had it happened to me albeit in the "failed to negotiate curve" category.

Show up. Fight it. Amazing how easy it is. Don't let them take advantage. They think they can get all of us then.
the price off tickets is why I stay out of oregon. Even though they have some great roads.

Bill!!! I'm glad you're ok! I'm sorry to hear that you went down. That seems like a silly ticket to get....I think that every one of us here would end up with a ticket if the police looked at our tires (?).... I'm not sure that wrekless / unsafe riding can be proven from scrubbed tires. Especially on a sport bike...you're SUPPOSED to ride on the sides of the tires - that's why they aren't flat on the bottoms (like a car's).

I hope that you feel much better soon. Let Lee and I know if there's anything that you need.

Bill, my heart sunk when I opened this thread. I am sorry to hear that this happened. I hope you heal up quick and strong, and please feel free to give a ring if you need anything or would just like to bench race while getting the bike back to great condition. As for you getting back to great condition, time is all you get to recovery, and I am very thankful you got that time!

When I picked up the bike the guy at the towing place told me there was a rumour that there was some "illegal racing" going on out there. Not sure how that BS story got started?

Don't worry Bill, the bikes in good hands. I promise not to rob any parts off it

Wow, I'm am glad you got away as well as you did!!

I am with the others. For 1 I would like to know what sportbike expert they have on hand that could judge if a tire had been ridden on aggressively. What guide lines would suggest that? There are so many different types of tires simply saying tires were scruffed up close to the edge shouldn't be able to hold up in court.

Not to mention that they couldn't say the scruffs are from that ride.

Just back from the doc and they put a cast on my thumb and have some broke ribs which makes it a pain getting up and down.Post the pics Kevin as I don't have any.Will probably be awhile for that parts list as my insurance didn't cover bodily damage to me.Plus the car is in the shop for bodywork from the parking lot fiasco and he found some stuff that wasn't fixed from the other rearender.Can only be a better day from here on out.

Broke some ribs too? Crap!. Don't worry about the bike. Get your health (and finances) back first. It will be ready when you are. Battery is on the tender and I'll wash off that brake fluid to avoid additional damage.

Here is the damage to the bike...

We were riding the road that goes from Long Creek to Kimberly, just North of John Day. Some nice roads over there. But like someone mentioned earlier, tickets in Oregon make it almost not worth it. Makes me appreciate what we have here even more.

I think you'll have good luck contesting the ticket. I think in most of Oregon, whenever there is an accident they have to ticket someone. I had a good friend get hit on a bicycle, spent the night in the ER and a few nights in the hospital. He was ticketed for failure to yield when all was said and done. He has no recollection of the accident, so was unable to testify for himself. He plead innocent and thankfully enough people convince the judge he did everything in his power to avoid the accident that the judge found him innocent.
